Truth Bomb by OVD : How a Bar can save Roe Vs Wade
Hey Everyone,
In the 1970's a Bar in Cambridge MA called Grendel's Den applied for a liquor license in the state of Massachusetts. At the time MA had a Law saying if your bar was near a church, the church had final approval of any liquor license. The church out back behind the bar said no...so Grendel's sued. It went all the way to the Supreme Court which ruled 8 to 1 in favor of the bar saying the government could NOT give it's authority and powers to a civilian or civilian entity. Setting precedence. Even stronger than Roe Vs Wade.
So how does this affect the Texas anti-choice law...simple. Texas used the fact that civilians would be reporting these "Law breakers" for financial gain. In attempt to circumvent Roe Vs Wade. Basically giving their state power to individuals. So as in MA where the State Government unconstitutionally gave their power to an non government entity( a church in that case) the Texas Law does the same. It violates the Constitution as Texas is giving State powers to Individuals.
The Lawyer for Grendel's , Lawrence Tribe says his precedent applies to this Texas Anti-Choice Law as the State of Texas is giving their authority to any nut case or group of nut cases that are against Abortion that authority making the law hands down Unconstitutional.
This would not only get Texas's Law thrown out but also the many copy cat Laws that are sure to come down the pipeline. If your in Texas I'd call Mr. tribe and sue the state of Texas. it's a guaranteed win. And will save Roe Vs Wade at least until the anti-choice morons come up with another ploy as they know now, the current SCOTUS is against abortion thanks to the Orange Nazi Moron and the Nazi party of America(formerly the Republican party).
